In Brazil, the state, federal, municipal agencies & foundations, all public companies as well as those with private participation are bound by the Tendering Law No. 8666 of 12 June 1993. The tendering law stipulates that all procurement services, works and goods have to be tendered with procurement centered on the best-price criteria. Corporations with non-controlling state participation need not follow general procurement rules and regulations. In Brazil many professional consultancies and law firms provide support to international bidders.

When it comes to involvement of foreign companies; the suppliers need to be legally recognized or represented in the country in order to qualify for government contracts. The international companies who do not have any operations in Brazil can only take part in international tenders entitled as such. In such a situation, the bidding object can be carried out in a foreign country and its price proposals are established in international currency. However the foreign company will still require legal representation in the country or else have a joint-venture with a Brazilian company. Other than this, companies will still have to prove their technical and financial capacity so as to be eligible as bidders.
